These terms and conditions govern the Switch Up to Bosch Promotion (“Promotion”) and are subject to change at the discretion of the Promoter. Such changes are subject to state regulation.
1. The Promotion commences on 1 March 2010 and ends on 31 July 2010 (“Promotional Period”).
ENTRY REQUIREMENTS
2. Information on how to enter forms part of these terms and conditions. Registration and participation in the Promotion constitutes an acceptance of these terms and conditions.
3. Entry into the Promotion is only open to:
- Automotive workshop owners who are Australian residents and who supply a current valid ABN for their workshop and who have registered for the Promotion in accordance with clause 4 (“Workshops”); and
- Distributors and resellers who supply and invoice Eligible Bosch/PBR Products directly to Workshops, and who also sign and adhere to the “Conditions of Distributor Participation” form provided by the Promoter (“Distributors”).
4. To be eligible to enter the Promotion, Workshops must:
- Register online by completing all details on the registration page at www.switchuptobosch.com.au or by completing all details on the “Switch Up to Bosch “ registration form and faxing this form to the nominated “Switch up to Bosch” fax number; and
- Purchase Eligible Bosch/PBR Products (as defined in clause 8) during the Promotional Period and each month register their Eligible Bosch/PBR Products purchased in accordance with clause 6.Workshops only need to register in accordance with clause 4(a) once for the Promotional Period. Only one registration in accordance with clause 4(a) per Workshop is permitted.
5. Every $100 (excl. GST) spent on Eligible Bosch/PBR Products during each calendar month within the Promotional Period entitles a Workshop to register their purchases and receive one entry in the current calendar month draw. For instance:

Purchases of Eligible Bosch/PBR Products must be validated by a commercial invoice confirming that goods have been received in order to claim prizes.
6. All total calendar month purchases of Eligible Bosch/PBR Products must be registered by a Workshop either online via www.switchuptobosch.com.au or by the nominated “Switch up to Bosch” fax number by 5.00pm (AEST) on the entries received date as outlined in Clause 17. Workshops that register for the Promotion in accordance with clause 4(a) on or by the last calendar day of any month within the Promotional Period may also register all of their Eligible Bosch/PBR Product purchases during that same month in the Promotion.
7. For the purposes of purchase registration, the day and month of purchase will be the day and month shown on a Distributor’s tax invoice that shows the amount and part numbers of Eligible Bosch/PBR Products purchased. If such tax invoices do not include Eligible Bosch/PBR Product part numbers, a Workshop must produce further proof of purchase of Eligible Bosch/PBR Products to the satisfaction of the Promoter to participate in this Promotion.
8. “Eligible Bosch/PBR Products” comprises the Bosch/PBR automotive aftermarket products listed on the ‘eligible products page’ at www.switchuptobosch.com.au, but excludes test equipment and power tools.
9. Entries are deemed to be accepted at the time of receipt and not at the time of sending. Incomplete, indecipherable, or illegible registrations will be deemed invalid. Any incorrect details submitted may render the corresponding entry invalid. The Promoter accepts no responsibility for any entries that are late, lost, misdirected or not received by the Promoter by a deadline for an individual prize draw or otherwise within the Promotional Period or for any delays in the delivery of entries due to any technical disruptions or for any other reason.
PRIZES TO BE WON
10. The total prize pool is valued at $122,000 (which is correct at the time of printing) and comprises:
WORKSHOP PRIZES:
- 1 Workshop early registration prize which is a $2,000 pre-paid Visa gift card (total prize value $2,000);
- 1 Major Workshop prize to be drawn each month during the Promotional Period which is a $5,000 travel voucher OR a $5,000 pre-paid Visa Gift Card (total of 5 prizes to be won, total prize value $25,000); and
- 30 Minor Workshop prizes each month during the Promotional Period, with each prize consisting of a $500 pre-paid Visa gift card (total of 150 prizes to be won, total prize value $75,000).
DISTRIBUTOR PRIZES:
- 1 Major Distributor prize each month during the Promotional Period which is a $1,000 pre-paid Visa gift card (total of 5 prizes to be won, total prize value $5,000) and
- 30 Minor Distributor prizes each month during the Promotional Period, with each prize consisting of a $100 pre-paid Visa gift card (total of 150 prizes to be won, total prize value $15,000).
11. All travel vouchers are issued by Pinpoint Travel Pty Ltd (trading as Travel On Sale) and are valid for 12 months from the date of issue. All travel bookings must be made directly with Travel On Sale. Contact details will be provided when the vouchers are issued.
12. All pre-paid Visa gift cards are issued by Universal Gift Card Pty Ltd and are governed by the terms and conditions of use at universalgiftcard.com.au.
13. Prizes must be taken as offered and cannot be transferred, exchanged, varied or taken as cash. If any prize (or part of any prize) is unavailable, the Promoter reserves the right to substitute the prize (or that part of the prize) with another of equal value and/or specification. Such changes are subject to state regulation. The Promoter accepts no responsibility for any variation in the value of any prize or any loss, theft or misuse of prizes. Any redemption or ancillary costs associated with redeeming a prize are the sole responsibility of each winner.
DISTRIBUTION OF PRIZES
14. Workshop early registration prize: Workshops who register for the Promotion in accordance with clause 4(a) by 5.00pm (AEST) on 31 March 2010 and spend a minimum of $100 (excluding GST) on Eligible Bosch/PBR Products during March 2010 and register their purchases either online via www.switchuptobosch.com.au or by the nominated “Switch up to Bosch” fax number by 10 April 2010, will be eligible to win the Workshop early registration prize listed in clause 10(a).This prize will be drawn on 15 April 2010. Each Workshop may only enter once to be eligible to win this prize.
15. Major Workshop prizes and Minor Workshop prizes: Workshops that have registered their purchases of Eligible Bosch/PBR Products as outlined in clause 6 will be eligible to win the Major Workshop Prizes and Minor Workshop prizes, to be drawn on the dates specified in clause 17.
16. Major Distributor prizes and Minor Distributor prizes:Each month, Distributor prize winners will be automatically determined in accordance with the winners of the Major Workshop prizes and Minor Workshop Prizes and the relevant winning Workshop’s Eligible Bosch/PBR Products purchased. The Distributor that supplies the majority of each winning Workshop’s Eligible Bosch/PBR Products (calculated by dollar value invoiced) in the month that the applicable Workshop prize is won will be deemed as the corresponding winner of the Major Distributor prize or the Minor Distributor prizes.
17 .Each monthly prize draw will take place on the following dates from entries received in accordance with clause 15 as follows:
- 15 April 2010 from entries received by 10 April 2010 for purchases of Eligible Bosch/PBR Products made during the calendar month of March 2010.
- 17 May 2010 from entries received by 10 May 2010 for purchases of Eligible Bosch/PBR Products made during the calendar month of April 2010.
- 17 June 2010 from entries received by 10 June 2010 for purchases of Eligible Bosch/PBR Products made during the calendar month of May 2010.
- 16 July 2010 from entries received by 10 July 2010 for purchases of Eligible Bosch/PBR Products made during the calendar month of June 2010.
- 16 August 2010 from entries received by 10 August 2010 for purchases of Eligible Bosch/PBR Products made during the calendar month of July 2010.
18. All draws will take place at 100 Reynolds Street, Balmain, NSW at 2.00pm (AEST).
19. The Promoter reserves the right to verify the validity of entries (including, but not limited to details of registered purchases corresponding with tax invoices) and participants (including but not limited to an entrant’s identity, ABN number, claimed Eligible Bosch/PBR Purchases and place of workshop address) and to disqualify any participant who submits an entry that is not in accordance with these terms and conditions, or who tampers or interferes with the entry process, or who submits an entry that the Promoter, in its sole discretion, deems to be offensive, inappropriate, defamatory or otherwise not in keeping with the spirit of the Promotion. If a winner is subsequently disqualified or their entry cannot otherwise be verified in accordance with this clause, that winner will forfeit their prize and that prize will be distributed in accordance with clause 20.
2nd CHANCE DRAW
20. Subject to any written directions issued by a regulatory authority, if any winning Workshop’s purchases of Eligible Bosch/PBR Purchases cannot be verified to the satisfaction of the Promoter within 14 days of the respective draw date specified in clause 17 or their entry otherwise does not comply with clause 19, that winner will forfeit their entitlement to the prize. The corresponding winning Distributor will also forfeit their entitlement to their prize. The Promoter will award that prize to one of 30 ‘’substitute’’ prize-winners that will also be drawn in corresponding order on each of the draws conducted as specified in clauses 17 and 18. Any substitute prize winner’s purchases of Eligible Bosch/PBR Purchases are also subject to verification.
NOTIFICATION OF WINNERS
21. Monthly winners’ names and 2nd chance prize draw winner’s names will be published at www.switchuptobosch.com.au once verified by the final day of each month that the draw and verification occurs. Monthly winner’s and 2nd chance prize draw winner’s names of all prizes valued at over $250 will also be published in the public notices section of The Australian on the 30th day of the month, dates include 30th April 2010, 30th May 2010, 30th June 2010, 30th July 2010 & 30th August 2010 that the draw and verification occurs. Winners will also be notified by mail and phone.
22. If a Workshop‘s address details or contact details changes, the Workshop must update their details by sending an email to info@switchuptobosch.com.au.
GENERAL TERMS AND CONDITIONS
23. All participants cannot transfer participation in the Promotion to any other person or entity.
24. It is the responsibility of each participant to seek independent professional advice in relation to any taxation effects arising from participation in the Promotion. In addition, each participant is responsible for any taxation liability (including GST) or other government fees and charges relating to participation.
25. The Promoter’s decision in relation to any aspect of the Promotion is final and binding on every person who enters and no correspondence will be entered into.
26. The Promoter and its agencies and companies associated with this Promotion shall not be liable for any loss or damage whatsoever which is suffered or sustained (including but not limited to indirect or consequential loss or for any personal injury or property damage) in connection with this Promotion or any prizes awarded in the course of this Promotion, except for any liability which cannot be excluded by law.
27. The Promoter and its officers, employees and agents will not be responsible for any inaccurate, incorrect or incomplete information received or not received in the course of or in connection with this Promotion if the deficiency is occasioned by any cause outside the Promoter’s reasonable control, including but not limited to, technical malfunctions or failures.
28. If for any reason this Promotion is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this Promotion, the Promoter reserves the right in its sole discretion (to the extent permitted by law) to suspend, cancel, terminate, modify or recommence the Promotion or disqualify an participant, subject to the written direction of any relevant regulatory authority.
29. Failure by the Promoter to enforce any of its rights at any time does not constitute a waiver of those rights.
30. Any costs associated with entry into this Promotion (including but not limited to accessing the website and submitting an entry) are the responsibility of each participant.
31. All entries become the property of the Promoter. The Promoter collects personal information about participants to enable participants to participate in the Promotion. If personal information is not provided, the participant may not participate in this Promotion. By entering this Promotion, participants agree that: (1) the Promoter may disclose personal information to its contractors and agents for the purpose of assisting in the conduct of the Promotion; and (2) the Promoter may retain and use personal information for future marketing purposes in relation to its products, services and offers, including sending SMS messages.
32. It is a condition of taking any prize that the winner consents to the Promoter to use the winner’s name, likeness, image and/or voice (including photograph, film and/or recording of the same) in the Promoter’s marketing materials without remuneration for an indefinite period.
